(7 December 2001) The following new laws, passed by the Illinois General Assembly and signed into law by Governor Ryan, may be of interest to the construction industry. 1) Revised One Call (JULIE) utility marking law (HB 2138, now Public Act 92-0179, effective 1 July 2002) - changes penalties and fines for excavation or demolition work affecting underground utility lines, and creates administrative structure for enforcing new law. Read our article on this subject.
2) Mobile Home Licensing (HB 681, now Public Act 92-0410, effective 1 January 2002) - charges the Illinois Department of Public Health (IDPH) with regulating mobile home manufacturers, except in Chicago.
3) Small business set-asides (SB 269, now Public Act 92-60, effective 12 July 2001) - raises maximum revenue limit for construction companies receiving set-aside contracts, from $3 million to $10 million.
4) Building code changes (SB 754, now Public Act 92-489, effective 1 July 2002) - requires counties, and cities other than Chicago, to notify the Illinois Building Commission 30 days before adopting a new or changed building code, to allow the Illinois Building Commission to post the changes on its Website.
5) Utility relocations on public rights-of-way (SB 699, now Public Act 92-0470, effective 1 January 2002) - provides State and county highway authorities with added leverage in requiring utilities to move their facilities in advance of highway projects. Read our article on this subject
6) Interest-bearing subcontractor retainage (HB 1904, now Public Act 92-0270, effective 7 August 2001) - now permitted on IDOT projects. Read our article on this subject.
7) New licensing requirements for plumbing contractors (HB 2148, now Public Act 92-0338, effective 10 August 2001)
8) County, municipality performance bonds for contractors, developers (HB2380, now Public Act 92-0479, effective 1 January 2002)
