Controversial Software Law Proposed in IL Legislature
(updated 17 March 2001) The controversial Uniform Computer Information Transactions Act, known as UCITA for short, was recently introduced in the Illinois State Legislature, as House Bill 3058. The legislation was introduced by Rep. Tom Cross, R-Yorkville (84th House District), and with minor changes, adopts the prototype version approved last year by the National Conference of Commissioners on Uniform State Laws (NCCUSL), a body responsible for developing uniform state laws such as the Uniform Commercial Code (UCC). UCITA will have far-ranging repercussions in areas ranging from Internet service, to software sales, to third-party ASPs (application service providers), including project websites. Given the 56-page length of House Bill 3058, and the 350-page length of the NCCUSL prototype, including commentary, it is doubtful that most people (including legislators) will take the trouble to read it, as we did. This also makes it likely that the bill may slip past the close scrutiny which every bill deserves.
House Bill 3058 has been re-referred to the House Rules Committee as of 16 March 2001.
